  • Google Closes Adsense Account - Google Gets Sued - Google LOSES!

    Important updates to blog improvement review contest, please re-read; leave any comments on that post :) .

    No I’m not keyword stuffing the title, but it has a good effect. And no it’s not my Google adsense account either; no reason to close what’s not in use.

    As I was making some rounds this morning I came across my buddy Mike at IM Is Easy and he had a VERY interesting story to share (not his account either).

    Now I’m not a Google hater per-say, but most will agree that it’s always satisfying to hear of David taking a piece of Goliath, even if just a small piece…..$721 in this case.

    Read the full story (new window). Pay close attention to the end where Google’s paralegal protested (quite loudly I’m sure), “What if everyone whose account was canceled sued Google?

    An intriguing question to be sure. What do you think?

      @Sire, I personally know someone who makes multiple six figures a year with AdSense and even more with other ad programs. He has hundreds of niche sites to do that.

      My old horse site made right around $400 a month every month because I created content pages specifically for keyword phrases I knew had higher than average bids. That was years ago before they started lowering the payouts though so I don’t know what it would make today if it still existed.

      Dumb litigator, if Google actually could show a reason for the termination of an account they would of won but as it seems no reason exists and so they lost.

      Now that he got his money back, I wonder if he went and joined Chitika or something, I certainly wouldn’t have given the satisfaction of running their ads. We do hold the balance of power as far as Google is concerned. If they piss off enough webmasters and bloggers and we all walked off and went to the opposition, you watch how fast they change their TOS and shit.

      I was shocked to read “Googles paralegal”. No offense to paralegals, but I would think Google would have much higher powered attorneys. Although it was small claims court I guess.

      I could relate very well to this story. My adsense account was closed just after 2 months which happened more than a year ago and the reason Google gave was also that my account posed “a significant risk” to advertisers. I didn’t do anything and possibly too new to know how to game the system even if there was a way anyway. About 5 months ago I wrote in to Google to ask for the real reason and appealed to get my account reinstated. Again it fell on deaf ears and it still said my account was “a significant risk” to advertisers”. Not sure it the reply came from a human or an android. Yeah maybe with this sued story I could appeal to Google one more time and this time I’ll quote this sued incident. Perhaps someone in Google will take a closer look at my case (sigh).

      Great find, Dennis. One of the most honest bloggers I know - who is not even active online as he is taking a short sabbatical - just had HIS AdSense account closed. No reason given and no answer to his appeal so far.

      It is about time Google had to answer to somebody else! I wonder if anyone who appealed has ever had their account reactivated? I’d love to hear from anyone who has. (Leave a comment here and I’ll see it.)

      Your friend wasn’t active but were his adsense sites online? Someone else could have easily done him in by clicking away on them.

      I didn’t think about that. If one person is clicking an abnormal amount on one site that won’t be good for advertisers. Even if nothing wrong is done by the site owner Google won’t like it.

      Google prob knows the ip addresses of whoever clicks. They may see patterns that indicate. “You click mine and I’ll click yours”

      @Dennis, Yes, his AdSense ads were online. What I meant by inactive was that he isn’t currently blogging and he is definitely wise enough that I’m sure he didn’t click any ads on his own sites.

      If Google is disabling accounts because visitors to a site are committing click fraud that is ridiculous. Their system can easily defeat extra clicks and no site owner can control what their visitors are doing.

      They are VERY quick to disable accounts and I don’t recall EVER hearing of them reinstating one. If they have surely someone will come by and let us know.

      I know some may get tired of hearing it but I’m warning everyone that Google has FAR too much power. Most sites and online stores get 60-70% or more of their traffic from Google. Because of that Google can put them out of business any time, either intentionally or because some algorithm slaps them.

      Every person needs to seriously find a way to diversify their sources of traffic. We need to find other ways to search. And we need to support each others’ efforts and businesses.

      We can change the world if we will just change what we support and what we buy while we still have some choices.

      With that kind of market share it could be argued that Google has monopoly powers. It might be interesting to see them in court about that. Of course the justice dept and the courts really screwed up in the Microsoft case. I guess interesting doesn’t mean better.

      @Ned Carey, They absolutely DO have a monopoly on search and ppc. I wonder it that isn’t by design. Surely both Yahoo and Microsoft can NOT be so incompetent that they have been unable to compete all this time and still can’t. Their ppc programs are a joke.

      The better an online store does SEO the more traffic they get from Google search and the more risk they have.

      The better they do with ppc the more traffic they get from Google and the more risk they have.

      Any time Google wants to increase their earnings they drop organic listings to drive ppc spending up. And that is NOT the only way Google takes money from advertisers.

      I made a VERY good living in ppc until what Google was doing became so obvious that I wasn’t willing to advise people to take such risks and set out to find ways to diversify traffic.

      I challenge anyone to name an online store that Google can’t severely damage or put out of business. If anyone has found another way to replace that traffic I’m all ears. Please do come to my blog and tell me what you’re doing.

      @GrowMap, Thought that I would update here as I am the blogger noted in this comment and received a response from Google today regarding my disabled account.

      As you can guess, my appeal was denied and the message indicated “Thanks for providing us with additional information. However, after thoroughly reviewing your account data and taking your feedback into consideration, we’ve re-confirmed that your account poses a significant risk to our advertisers. For this reason, we’re unable to reinstate your account. Thank you for your understanding.”

      As GrowMap noted, I have been taking a break from my blogs and have certainly not been out there clicking my own ads. My earnings have been pretty steady in the range of ~$100 per month and the month of March was off to a typical start. The only change I made recently was that I paused all of my AdWords campaigns, but I doubt (or should I say hope) that there is any correlation.

      So my account has been disabled and my appeal has been denied. Nobody has been able to give me an answer as to why my account has been disabled and it certainly wasn’t anything that I was doing, nor do my statistics even support anything unusual that anyone else was doing. Yet somehow I still pose a significant risk to advertisers.

      One of the most frustrating parts of the whole process is that I cannot even log into my account to view the reports to see if there last day or two prior to the account being disabled had any suspicious click activity.

      Thanks for making mention of this article and providing the forum for discussion. I’ll be happy to answer any questions about my account being disabled, however there aren’t many details to go on. =)

      @Derek, I am really sorry to hear that but am not surprised as I have never heard of any successful appeal ever. There ARE alternatives. I’ll be researching them and will post the results in hopes others will come by and share what has worked for them.

      Google has far too much power and there is not anything any of us can do about it except use alternatives as much as possible. I just saw some Tweets today about someone using Twitter search and Tweets instead of search to find whatever they want online. Might be worth a try.

      To the question I agree with Aaron Greenspan, “Maybe everyone whose account was canceled, should [sue].”

      I just lost my Amazon.com associate’s account for something I didn’t do. It’s ridicules that these large companies think it’s reasonable to ignore customer service and the LAW because ‘they are too big’. If they’re too big to run properly they should be broken up into parts and given to me and Dennis to run :)

      @Peter, That’s about the only way I’ll make any real money from them Peter. My AdSense earnings went from about $300/month to a hundred dollar check every six or eight months. I have all but stoped running the ads but may start again with niche sites.

      @Peter@passive income ideas, That is not a bad idea. Set up a post and let us know. You do know though that Google may retaliate. Many will not sue Google because they can put them out of business.

      @Brian Google keeps their income going by squeezing us on both ends. They charge AdWords users for junk traffic and set up their system to keep spending levels up when advertisers start limiting advertising spend. And they lower payouts to publishers.

      I recently shared an interview post with Google where they said “they can’t imagine” their income going down. What I’ve just typed is why it doesn’t go down. They control both sides of the equation and can artificially inflate earnings at the expense of those using their systems.

      Instead of using AdSense consider the alternatives. There are many of them now. We should do a study and see which pay best.

      I recently commented on a post recommending promoting Wal-Mart of all things. With all the bad publicity Wal-Mart generates doesn’t get the general public to shop elsewhere the odds of improving our economy aren’t very good.

      I can’t see Google losing too much sleep about the one individual account (case) but, as Google’s para-legal stated, “What if everyone whose account was canceled sued Google?”.. now, I do think they’ll be thinking about this for a while to come!

      Maybe its time Google set up a better appeal process rather than just to say their decision is final and then they wont find themselves in the situation of having to go to court the next time an account is closed.

      @BB, Winning in court is one thing; collecting is another. Perhaps though in the case of Google that won’t be as big an issue. For many, winning in court rarely results in actually seeing any money.

      Google penalizes paid do follow because they don’t want it to manipulate rankings unfairly…if they charge for advertising who does it help or hurt…they’re already on Google. lol

      @Dennis Edell, Oh, I understand the issue, Dennis, but at the same time, Google already has algorithms that supposedly know when a link is to something that’s not related to a site, and gives it less “juice”, so to speak, than a link that has a related topic. So, I don’t really see why they should care.

      Then again, I do still stick with the thing that says I don’t really care about page rank. It’s such an arbitrary thing, as we’ve both seen some websites that are junk sitting there with a PR 5 or 6, whereas some great sites with great content are sitting at a 2 or 3. As long as they’re not penalizing people by deindexing them, then it’s all good.

      @Mitch, It all breaks down pretty simple for me. If you want to stay on Googles good side and they don’t want you to do X, don’t do X. It’s not that difficult.

      IF you REALLY didn’t do anything wrong and get penalized (much rarer then we’re led to believe) then speak up….they do actually listen.

      @Dennis Edell, I’m not worried about it at all. Overall, I don’t care about PR; I do care about being listed, and if that happens, then I might worry a little bit more about it. You saw my traffic stats; search engines overall are less than 30%, and Google may be the big dog after that, but I still get 75% of my traffic from elsewhere.

      As Sire said, I won’t be bullied.

      The ‘big G’ does try to keep everything hidden behind smoke & mirrors - this breeds resentment (applying a penalty to part of your site and not telling you that they have - then not telling you why - leaving you to guess and wait weeks to see if you have guessed right for example).       @JasonTruckMaster, Very true. I can understand their algorithm hushness due to those that try to scam it, but they have definitly pushed it too far into other areas that needn’t be so secret.

      I think (hope) the more people look for alternatives, the more they may realize their mistakes.

      In one sense aren’t we all trying to scam it. Google considers a link to your site a vote for you site. If we are creating links isn’t it like voting for ourselves? This is clearly not what Google intends and they state it as such.

      I truly wonder how many people that that are upset because they get slapped by Google have done things that are clearly against their overall policy but seemed to work in a past algorithm.

      If there’s no proof that shows the site owner did indeed violate the terms and commit click fraud, then the owner has every right to the money. I don’t think it’s fair that Google can just close accounts at their leisure without probable cause.

      As for the attorney’s rebuttal, I think everyone should sue Google if they were falsely accused. If you want any chance of getting the money you’re owed, it seems that would be the only course of action to get it.

      It appears to be an ever increasing issue. I’m just happy it hasn’t happened to me yet. I’m still waiting for my first check, and hopefully it will be soon.

      i did hear a lot about this i feel bad for that guy

      if that guy chooses to optimize his website google would probably blacklist his website since google is the big brother of the internet one day it will rule every thing that involves technology or the web

      they probably got so fed up with people gaming adsense or paying out large amounts of cash to people so they decided to terminate his account but he will never be able to get another adsense account ever

      i guess 721 dollars meant the world for him but i can’t blame it either since googles tos guideline are unfair to any blogger or publisher that uses their service because it clearly states that any earning made with adsense can be unpaid if they decide to cancel your account for any reason an whenever they choose to

      @almir, You’re right, in a way Almir, but it’s patently unfair, and this lawsuit proved it. They didn’t cite him for click fraud; heck, they didn’t cite him for anything.

      I received one of those emails once saying that my account might be in violation. Since I knew I wasn’t doing anything wrong, I figured it had to be tied into one of those blogging sites I belonged to where you had your number rotate with the sites number, which I never trusted, and never made any money from anyway.

      It can look scary, for sure, especially if you’re making money from Adsense.
